April 2026 in Bursa (T\u00fcrkei)<\/strong> bei einem gezielten bewaffneten Angriff get\u00f6tet wurde.<\/p>\n<p>Nach den vom Istanbuler Anwaltsverband \u00fcbermittelten Informationen wurde <strong>RAin Hatice Kocaefe<\/strong> von einer Person ermordet, die Schuldnerin in einem Vollstreckungsverfahren war, das die Anw\u00e4ltin im Rahmen ihrer beruflichen T\u00e4tigkeit eingeleitet hatte. Sie wurde somit ausschlie\u00dflich aufgrund ihrer Berufsaus\u00fcbung als Anw\u00e4ltin get\u00f6tet.<\/p>\n<p>Dieser Mord stellt einen <strong>\u00e4u\u00dferst schwerwiegenden Angriff auf den Anwaltsberuf und das Recht auf Verteidigung<\/strong> sowie auf den Rechtsstaat dar. Gewalt gegen Anw\u00e4lte i ist gleichbedeutend mit einem direkten Angriff auf das Funktionieren der Justiz selbst.<\/p>\n<p>Das Observatorium erinnert daran, dass gem\u00e4\u00df den <strong>Havanna-Grunds\u00e4tzen der Vereinten Nationen<\/strong> <strong>\u201eAnw\u00e4lte d\u00fcrfen aufgrund der Aus\u00fcbung ihrer T\u00e4tigkeit weder mit ihren Mandanten noch mit den Anliegen ihrer Mandanten gleichgesetzt werden.\u201c (Grundsatz 18)<\/strong> Bedrohungen, Einsch\u00fcchterungen und Gewalttaten im Zusammenhang mit der Aus\u00fcbung des Anwaltsberufs den grundlegenden Prinzipien des internationalen Rechts widersprechen und die Unabh\u00e4ngigkeit der Justiz beeintr\u00e4chtigen.<\/p>\n<p>Das OIAD begr\u00fc\u00dft die Solidarit\u00e4tsma\u00dfnahmen, die von der Rechtsanwaltskammer Istanbul, der Rechtsanwaltskammer Bursa und der Union der t\u00fcrkischen Rechtsanwaltskammern ergriffen wurden, und erkl\u00e4rt seine uneingeschr\u00e4nkte Solidarit\u00e4t mit der gesamten t\u00fcrkischen Rechtsgemeinschaft.<\/p>\n<p>Das OIAD fordert die t\u00fcrkischen Beh\u00f6rden auf:<\/p>\n<ul>\n<li>eine <strong>rasche, unabh\u00e4ngige und wirksame Untersuchung<\/strong> zur Ermordung von RAin Hatice Kocaefe durchzuf\u00fchren;<\/li>\n<li>alle Verantwortlichen im Einklang mit den internationalen Standards strafrechtlich zu verfolgen;<\/li>\n<li><strong>unverz\u00fcgliche und wirksame Ma\u00dfnahmen<\/strong> umzusetzen, um den Schutz der Anw\u00e4lte bei der Aus\u00fcbung ihrer T\u00e4tigkeit sicherzustellen.<\/li>\n<\/ul>\n<p>Abschlie\u00dfend bekr\u00e4ftigt die OIAD die <strong>dringende Notwendigkeit der Ratifizierung des \u00dcbereinkommens des Europarates \u00fcber den Anwaltsberuf durch die T\u00fcrkei<\/strong>, um die Sicherheit der Anw\u00e4lte sowie die Achtung des Rechtsstaats zu gew\u00e4hrleisten.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<h2><a id=\"Alerta1\"><\/a>Equatorial Guinea: arbitrary detention of lawyer Anacleto Micha Ndong Nlang after allegations of torture<\/h2>\n<p><strong>13 November 2024<\/strong><\/p>\n<p><strong>Anacleto Micha Ndong Nlang is an Equatoguinean lawyer and human rights activist, member of the platform\u00a0<em>Guinea Ecuatorial Tambi\u00e9n Es Nuestra\u00a0<\/em>(\u2018Equatorial Guinea is also ours\u2019).\u00a0<\/strong><strong>Tortured before his arrest in January 2024, his place of detention is inaccessible to his family and lawyers.<\/strong><\/p>\n<p>Anacleto Micha Ndong Nlang was arrested in September 2022 when he provided food and water to members of the opposition party\u00a0<em>Ciudadanos por la Innovaci\u00f3n<\/em>\u00a0(Citizens\u00a0<em>for Innovation<\/em>\u00a0) who were under police siege.<\/p>\n<p>Anacleto Micha Ndong Nlang was arrested in September 2022 when he provided food and water to members of the opposition party\u00a0<em>Ciudadanos por la Innovaci\u00f3n<\/em>\u00a0(Citizens\u00a0<em>for Innovation<\/em>\u00a0) who were under police siege. Charged with \u2018\u00a0<em>insulting the government, unlawful assembly, breach of security<\/em>\u00a0<em>\u2019<\/em>, the lawyer was transferred to Black Beach prison and was not released until June 2023, after 271 days without being able to contact his family.<\/p>\n<p>In September 2023, the lawyer filed a complaint for kidnapping, assault and battery, death threats, armed robbery, psychological and physical torture, cruel and inhuman treatment, false accusations, illegal detention, deprivation of liberty and communication, against a group of people including his alleged torturer, Sergeant Emiliano Nve Eyama, who works at Black Beach prison.<\/p>\n<p>In December 2023, Ndong Nlang was summoned by the police. The lawyer refused orders to make a video refuting his complaint and was detained\u00a0<em>in situ<\/em>\u00a0for 4 days without charge.<\/p>\n<p>The lawyer was brutally arrested on 26 January 2024. The police held him for 33 days without informing him of the charges against him. It was not until March 2024 that Anacleto Micha Ndong Nlang learned that his arrest was linked to his complaint against Sergeant Emiliano Nve Eyana. He was transferred again to Black Beach prison, where the Sergeant works.<\/p>\n<p>The Ministry of Justice initially authorised visits from his lawyers and activists, but Anacleto Micha Ndong Nlang disappeared from prison in April 2024. It was not until some of the activists imprisoned with the lawyer were released that they reported that Anacleto Micha Ndong Nlang was being held at the Oveng Azem high security prison in Mongomo.<\/p>\n<p><strong>The Observatory strongly condemns<\/strong>\u00a0the arbitrary detention of Anacleto Micha Ndong Nlang for having denounced acts of torture perpetrated by a State agent.<\/p>\n<p><strong>The Observatory urges the Equatoguinean authorities<\/strong>\u00a0to release the lawyer immediately and unconditionally, believing that this arbitrary detention is intended to silence him and discourage other lawyers from denouncing human rights violations committed by State agents.<\/p>\n<p><strong>The Observatory urges<\/strong>\u00a0the opening of an impartial and transparent investigation into the accusations of torture made by Anacleto Micha Ndong Nlang, in accordance with the State\u2019s obligations to prevent and punish acts of torture, as well as its duty to protect those who denounce such violations.<\/p>\n<p><strong>The Observatory recalls<\/strong>\u00a0that, in accordance with the\u00a0<strong>basic principles of the United Nations relating to the role of the Bar<\/strong>, in particular\u00a0<strong>principles 16, 17 and 23 :<\/strong><\/p>\n<p><em>\u201cGovernments shall ensure that lawyers (a)\u00a0<strong>are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference<\/strong>; (\u2026).\u201d\u00a0<\/em>(<u>Principle 16)<\/u><\/p>\n<p><em>\u201cWhere the security of lawyers is threatened as a result of discharging their functions, they shall be\u00a0<strong>adequately safeguarded by the authorities<\/strong>.\u201d<\/em>\u00a0(<u>Principle 17)<\/u><\/p>\n<p><em>\u201c<strong>Lawyers like other citizens are entitled to freedom of expression, belief, association and assembly<\/strong>. In particular, they shall have the right to take part in public discussion of matters concerning the law, the administration of justice and the promotion and protection of human rights and to join or form local, national or international organizations and attend their meetings, without suffering professional restrictions by reason of their lawful action or their membership in a lawful organization.
