{"id":10651,"date":"2025-01-21T09:11:37","date_gmt":"2025-01-21T09:11:37","guid":{"rendered":"https:\/\/protect-lawyers.org\/case\/botagoz-jardemalie\/"},"modified":"2025-03-26T09:47:15","modified_gmt":"2025-03-26T09:47:15","slug":"botagoz-jardemalie","status":"publish","type":"listing","link":"https:\/\/protect-lawyers.org\/en\/case\/botagoz-jardemalie\/","title":{"rendered":"Botagoz Jardemalie"},"content":{"rendered":"<ul>\n<li><a href=\"https:\/\/protect-lawyers.org\/en\/case\/botagoz-jardemalie\/#Alerta2\">ALERT 21\/01\/2025<\/a><\/li>\n<li><a href=\"https:\/\/protect-lawyers.org\/en\/case\/botagoz-jardemalie\/#Alerta1\">ALERT 20\/03\/2020<\/a><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><a id=\"Alerta2\"><\/a>KAZAKHSTAN:\u00a0Transnational persecution of refugee lawyer Botagoz Jardemalie<\/h2>\n<p><strong>21 January 2025<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Following the raid on the home of Ms Jardemalie, carried out in the context of international criminal cooperation with Kazakhstan, the Belgian Constitutional Court granted the lawyer a right of appeal to make it possible for her to defend herself against transnational repression by Kazakhstan. However, Kazakhstan was granted access to the case file and was invited to the proceedings by the Belgian public prosecutor.<\/strong><\/p>\n<p>Human rights lawyer Botagoz Jardemalie continued to be persecuted despite her refugee status in Belgium. The Belgian government had given assurances that cooperation with Kazakhstan would be suspended while her case was being processed. However, Kazakhstan received a copy of the documents used to execute the Kazakh letter rogatory. It was also invited to attend the proceedings by the public prosecutor. Ultimately, the Brussels Indictment Division declared that this participation was not legally justified.<\/p>\n<p>Kazakhstan had sent a request for mutual legal assistance to Belgium in connection with the criminal proceedings that had justified the granting of refugee status to Mr Jardemalie, whose brother had been arbitrarily arrested and tortured in Kazakhstan.<\/p>\n<p>This situation is totally incompatible with the fundamental rights of the defence and the obligations set out in the European Convention on Human Rights. The concerns expressed by Mr Jardemalie\u2019s defence have been ignored in favour of a blind trust in Kazakhstan, a notoriously authoritarian state practising transnational repression.<\/p>\n<p>In 2019, the Working Group on Arbitrary Detention, the Special Rapporteur on the independence of judges and lawyers and the Special Rapporteur on the right to privacy had already called on Belgium regarding the violation of Botagoz Jardemalie\u2019s rights.[1]<\/p>\n<p><strong>The Observatory reiterates\u00a0<\/strong>its full support for Botagoz Jardemalie.<\/p>\n<p><strong>The Observatory remains very concerned\u00a0<\/strong>about the mutual legal assistance between Belgium and Kazakhstan, which jeopardises the lawyer\u2019s fundamental rights.<\/p>\n<p><strong>The Observatory calls on the Belgian authorities\u00a0<\/strong>to guarantee effective security and protection for Ms Jardemalie and to be vigilant against transnational persecution.<\/p>\n<p><strong>The Observatory urges the Kazakh authorities\u00a0<\/strong>to cease transnational persecution of Ms Jardemalie.<\/p>\n<p><strong>The Observatory recalls\u00a0Article 3 of the\u00a0United Nations Convention against Torture<\/strong>, which states that \u201c<em>1. No State Party shall expel, return (\u201crefouler\u201d) or extradite a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture. 2.\u00a0<\/em><em>For the purpose of determining whether there are such grounds, the competent authorities shall take into account all relevant considerations including, where applicable, the existence in the State concerned of a consistent pattern of gross, flagrant or mass violations of human rights.<\/em>\u201d<\/p>\n<p><strong>The Observatory recalls that<\/strong>, in accordance with the<strong>\u00a0United Nations Basic Principles on the Role of the Bar<\/strong>, in particular<strong>\u00a0principles 16 and 17:<\/strong><\/p>\n<p><em>\u201cGovernments shall ensure that lawyers (a)\u00a0<strong>are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference<\/strong>; (b) are able to travel and to consult with their clients freely both within their own country and abroad; and (c) shall not suffer, or be threatened with, prosecution or administrative, economic or other sanctions for any action taken in accordance with recognized professional duties, standards and ethics.\u201d\u00a0<\/em>(<u>Principle 16)<\/u><\/p>\n<p><em>\u201cWhere the security of lawyers is threatened as a result of discharging their functions, they shall be\u00a0<strong>adequately safeguarded by the authorities<\/strong>.\u201d<\/em>\u00a0(<u>Principle 17)<\/u><\/p>\n<p>[1]\u00a0<a href=\"https:\/\/spcommreports.ohchr.org\/TMResultsBase\/DownLoadPublicCommunicationFile?gId=24908\" target=\"_blank\" rel=\"noopener\">https:\/\/spcommreports.ohchr.org\/TMResultsBase\/DownLoadPublicCommunicationFile?gId=24908<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h2><a id=\"Alerta1\"><\/a>KAZAKHSTAN: Search of the Belgian and Kazakh Authorities at the home of the refugee lawyer Botagoz Jardemalie<\/h2>\n<p><strong>20 March 2020<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>On the 1<sup>st<\/sup>\u00a0October 2019, Belgian police carried out a search without a warrant at the home of the human rights lawyer and Kazakh refugee in Belgium, Botagoz Jardemalie.<\/strong><\/p>\n<p>According to information received, the Belgian authorities have responded to a request for judicial cooperation with the Kazakhstan concerning the political refugee\u00a0<strong>Botagoz Jardemalie<\/strong>, who was granted refugee status in 2013.<\/p>\n<p>The search tooks place at her apartment while the lawyer was away and the police did not present any warrants to her family members who were present and who had requested one. In addition,\u00a0<strong>the police were accompanied during the search of\u00a0<a href=\"http:\/\/latribune.avocats.be\/botagoz-jardemalie\/\" target=\"_blank\" rel=\"noopener\">two Kazakh officials<\/a><\/strong>\u00a0(a magistrate and a member of the anti-corruption services)\u00a0<strong>even though the lawyer had obtained refugee status in Belgium, due to the persecution of the Kazakh regime against her.<\/strong><\/p>\n<p><strong>Many computer tools and confidential files were seized during this search, as well as data covered by professional secrecy in connection with her activities as a lawyer.<\/strong>\u00a0The access codes entered, in particular to mailboxes, Facebook, Instagram or other social networks, have already been used to intrude into Ms. Jardemalie\u2019s mailboxes.<\/p>\n<p><strong>These seizures could have serious repercussions on the safety of the lawyer and her clients<\/strong>\u00a0since her couriers contained privileged and confidential communications and sensitive information about her clients. The seizures could also have consequences for the safety of his brother, Iskander Yerimbetov, who has been held in political detention in Kazakhstan since the 13<sup>th<\/sup>\u00a0of November 2017. Allegations of ill-treatment and torture against him have been reported and highlighted by several human rights organizations. On November 20<sup>th<\/sup>\u00a02018, the United Nations Working Group on Arbitrary Detention concluded that Mr. Yerimbetov\u2019s detention was arbitrary and illegal, in violation of articles 9 (right to liberty and security of the person) and 14 (right to a fair trial) of the Covenant, and requested his immediate release (<a href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/Detention\/Opinions\/Session83\/A_HRC_WGAD_2018_67.pdf\" target=\"_blank\" rel=\"noopener\"><strong>link to the decision<\/strong><\/a>). Mr. Yerimbetov has also been internationally recognized as a political prisoner, notably by the European Parliament and the US State Department.<\/p>\n<p>At a\u00a0<a href=\"https:\/\/en.odfoundation.eu\/a\/26871,belgian-parliament-interrogates-minister-of-justice-over-the-case-of-bota-jardemalie\/\" target=\"_blank\" rel=\"noopener\">hearing on November 6<sup>th<\/sup>\u00a02019<\/a>, the Minister of Justice, Koes Geens, was able to explain a number of points raised by members of the Belgian Federal Parliament. According to him, this judicial cooperation is based on the United Nations Conventions against Organized Crime and Corruption, as well as the European Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime, all ratified by Belgium and Kazakhstan. In the light of these texts, the search was then authorized by the investigating judge.<\/p>\n<p>According to the Minister of Justice, mutual legal assistance was granted to collect evidence in a multi-billion dollar misappropriation case to which the Kazakh lawyer would be linked. Similar procedures have been authorized in France, Luxembourg, Switzerland and the United Kingdom concerning the same case. The Minister adds that refugee status does not provide immunity to a person guilty of an offence.<\/p>\n<p>However, members of Parliament recalled that Kazakhstan was known for its authoritarian regime, the harassment of its political opponents, its endemic corruption at the highest levels of the country and the lack of independence of its judicial system.<\/p>\n<p>On October 7<sup>th<\/sup>, lawyer Ronit Knaller filed a criminal complaint on behalf of Jardemalie for unauthorized access to a computer system, theft of electronic data, invasion of privacy and other offences.<\/p>\n<p>The Belgian State, which has accepted such cooperation with Kazakhstan, also judges spies at the same time. Indeed,\u00a0<strong>two East German Stasi agents and a German pseudo-journalist\u00a0<a href=\"https:\/\/www.lesoir.be\/263653\/article\/2019-11-29\/trois-barbouzes-condamnes-pour-lespionnage-de-la-refugiee-kazakhe-bota\" target=\"_blank\" rel=\"noopener\">were sentenced on November 29<sup>th<\/sup>\u00a02019<\/a>\u00a0to two years\u2019 imprisonment and a fine of 9,600 euros for criminal association, private corruption, harassment and violation of the Detectives Act against Ms Jardemalie.<\/strong>\u00a0Their mission was to gather information on Mrs. Jardemalie, who at the time defended the interests of businessman Mukhtar Ablyazov, an opponent of the central Kazakh government.<\/p>\n<p>The Federal Prosecutor\u2019s Office suspected that the three men had tried to take her by force to Kazakhstan.
