Ms Jones&#8217; client had been excluded from internal decisions and had entrusted her with the task of negotiating his exit and the eventual sale of his shares. Mr Aladib demanded the execution of the public contract and the reimbursement of his shares for an amount of two million Euros.<\/p>\n<p>During a board general meeting of Wayang in April 2023, attended by other shareholders and lawyers, a conversation was recorded without Ms Jones&#8217; knowledge.<\/p>\n<p>On 3 October 2025, Equatorial Guinea&#8217;s national television broadcast a 30-second edited extract from this recording. It suggested that Ms Jones had solicited a bribe of two million as the representative of the daughter of the Equatorial Guinean President, Mar\u00eda Jes\u00fas Obiang Mangue (Mohamad Aladib&#8217;s ex-wife).<\/p>\n<p>The recording was altered, and the statements taken out of context suggest that Gemma Jones was blackmailing Wayang, when in fact she was referring to financial irregularities within the company and threatening to refer the matter to the National Anti-Corruption Department. This misleading broadcast was intended to divert attention from a corruption scandal involving several prominent figures in Equatorial Guinea.<\/p>\n<p>Since the broadcast, Ms Jones and her firm have been facing a massive smear campaign on social media. Although the public broadcaster has stopped airing the report, the manipulated content continues to circulate online, causing lasting damage to her reputation<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/p>\n<p>This attack is yet another attempt to intimidate a lawyer committed to protecting democracy and the rule of law.<\/p>\n<p><strong>The Observatory strongly condemns\u00a0<\/strong>this smear campaign orchestrated by the public media.<\/p>\n<p><strong>The Observatory calls\u00a0on the national television <\/strong>station to issue a public apology and an official rectification of the situation.<\/p>\n<p><strong>The Observatory urges the Equatorial Guinean authorities\u00a0<\/strong>to open an independent investigation into the manipulation of the recording and the damage done to Ms Gemma Jones&#8217; reputation.<\/p>\n<p><strong>The Observatory calls <\/strong>for\u00a0guarantees to be given for the safety of the lawyer and her team when travelling.<\/p>\n<p><strong>The Observatory recalls to the Republic of Equatorial Guinea the\u00a0<\/strong><a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/basic-principles-role-lawyers\" target=\"_blank\" rel=\"noopener\"><strong>United Nations Basic Principles on the Role of Lawyers<\/strong><\/a>, in particular\u00a0<strong>Principle 17<\/strong>: \u201c<em>Where the security of lawyers is threatened as a result of discharging their functions, they shall be adequately safeguarded by the authorities\u201d<\/em>.<\/p>\n<p><strong>The Observatory also recalls\u00a0Article 17 of the\u00a0<\/strong><a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/international-covenant-civil-and-political-rights\" target=\"_blank\" rel=\"noopener\"><strong>International Covenant on Civil and Political Rights<\/strong><\/a>, which states that: \u201c<em>1. In addition to being disbarred throughout the country, the lawyer will not be able to grant \u201cvenia concedendi\u201d to other lawyers to replace her in her current cases.<\/strong><\/p>\n<p>The final sanction of disbarment, adopted on 10 July 2024, settles an irregular and groundless disciplinary procedure against lawyer Gemma Jones. The facts date back to 24 November 2023, when Gemma Jones published a video on Tik Tok, in which she shared her critical opinion of the Equatoguinean judicial and social system.<\/p>\n<p>After being intimidated[1], on 19 January 2023, solicitor Gemma Jones was temporarily suspended from practice as a precautionary measure in the disciplinary proceedings against her. The UN Special Rapporteur on the Independence of Judges and Lawyers, Margaret Satterthwaite, has already expressed concern at reports that\u00a0<em>\u201cthe sanctions imposed on Ms Jones were adopted on the basis of irregular statutes and that, although applicable, the procedural processes established by these allegedly irregular statutes were not followed\u201d<\/em><em><strong>[2]<\/strong><\/em><em>.<\/em><\/p>\n<p><strong>The Observatory condemns\u00a0<\/strong>the definitive suspension of lawyer Gemma Jones, banning her from practising her profession nationwide for two years.<\/p>\n<p><strong>The Observatory condemns\u00a0<\/strong>the prohibition on the transfer of her current cases to other lawyers to act on her behalf in professional cases, in violation of her clients\u2019 right to defence and right to effective judicial protection.<\/p>\n<p><strong>The Observatory recalls that,\u00a0<\/strong>in accordance with<strong>\u00a0the United Nations basic principles on the role of the Bar, particularly principles 19 and 23:<\/strong><\/p>\n<p><em>\u201cNo court or administrative authority before whom the right to counsel is recognized shall refuse to recognize the right of a lawyer to appear before it for his or her client unless that lawyer has been disqualified in accordance with national law and practice and in conformity with these principles.\u201d\u00a0<\/em>(<u>Principle 19)<\/u><\/p>\n<p><em>\u201c<\/em><strong><em>Lawyers like other citizens are entitled to freedom of expression, belief, association and assembly<\/em><\/strong><em>. Apr\u00e8s avoir fourni les documents requis, des documents compl\u00e9mentaires relatifs \u00e0 ses \u00e9tudes lui ont \u00e9t\u00e9 demand\u00e9s. Elle a ensuite \u00e9t\u00e9 convoqu\u00e9e par le B\u00e2tonnier \u00e0 une r\u00e9union avec le Conseil de l\u2019Ordre des avocats le 28 novembre.<\/p>\n<p>Les statuts de l\u2019Ordre des avocats pr\u00e9voient qu\u2019une d\u00e9cision de sanction doit \u00eatre prise \u00e0 l\u2019unanimit\u00e9 par tous les membres du Conseil de l\u2019Ordre. Au m\u00e9pris de ces dispositions, seuls si\u00e9geaient le B\u00e2tonnier, Juan Olo, et le Secr\u00e9taire de l\u2019Ordre des avocats, Juan Abaga.<\/p>\n<p>Le B\u00e2tonnier a affirm\u00e9 avoir \u00e9t\u00e9 convoqu\u00e9 par une autorit\u00e9 sup\u00e9rieure dans le but de sanctionner l\u2019avocate, all\u00e9guant qu\u2019elle avait viol\u00e9 les r\u00e8gles d\u00e9ontologiques professionnelles en publiant la vid\u00e9o.\u00a0 L\u2019avocate affirme qu\u2019une atmosph\u00e8re intimidante r\u00e9gnait au cours de la r\u00e9union\u00a0: il lui a \u00e9t\u00e9 dit qu\u2019elle \u00ab\u00a0creusait sa propre tombe\u00a0\u00bb et qu\u2019elle avait d\u00e9j\u00e0 \u00e9t\u00e9 avertie.<\/p>\n<p>Ce n\u2019est pas la premi\u00e8re fois que l\u2019avocate Gemma Jones, \u00e9galement inscrite au Barreau de Madrid, subit des repr\u00e9sailles pour s\u2019\u00eatre exprim\u00e9e et avoir critiqu\u00e9 le syst\u00e8me judiciaire en Guin\u00e9e \u00e9quatoriale, puisqu\u2019elle a \u00e9t\u00e9 d\u00e9tenue arbitrairement en septembre 2021, comme l\u2019a rapport\u00e9 l\u2019Observatoire.<\/p>\n<p><strong>L\u2019avocate attend la sanction annonc\u00e9e et a \u00e9t\u00e9 contrainte de quitter le pays pour des raisons de s\u00e9curit\u00e9.<\/strong><\/p>\n<p><strong>L\u2019OIAD condamne les actes d\u2019intimidation\u00a0<\/strong>\u00e0 l\u2019encontre de l\u2019avocate Gemma Jones et demande aux autorit\u00e9s \u00e9quatoguin\u00e9ennes de garantir sa s\u00e9curit\u00e9 et son droit \u00e0 exercer sa profession sans interf\u00e9rence.<\/p>\n<p>\u00c0 cet \u00e9gard,<strong>\u00a0l\u2019OIAD appelle les autorit\u00e9s \u00e9quatoguin\u00e9ennes \u00e0 veiller au respect des Principes de base des Nations unies relatifs au r\u00f4le du barreau,\u00a0<\/strong>en particulier<strong>\u00a0les principes 16 et 23 :<\/strong><\/p>\n<p><strong>Principe 16\u00a0<\/strong>:\u00a0<em>\u00ab\u00a0Les pouvoirs publics veillent \u00e0 ce que les avocats a) puissent\u00a0<strong>s\u2019acquitter de toutes leurs fonctions professionnelles sans entrave, intimidation, harc\u00e8lement ni ing\u00e9rence indue<\/strong>; (\u2026); et c)\u00a0<strong>ne fassent pas l\u2019objet, ni ne soient menac\u00e9s de poursuites ou de sanctions \u00e9conomiques ou autres pour toutes mesures<\/strong>\u00a0prises conform\u00e9ment \u00e0 leurs obligations et normes professionnelles reconnues et \u00e0 leur d\u00e9ontologie.\u00a0\u00bb<\/em><\/p>\n<p><strong>Principe 23\u00a0<\/strong>:\u00a0<em>\u00ab\u00a0Les avocats, comme tous les autres citoyens,\u00a0<strong>doivent jouir de la libert\u00e9 d\u2019expression,<\/strong>\u00a0de croyance, d\u2019association et de r\u00e9union. En particulier,\u00a0<strong>ils ont le droit de prendre part \u00e0 des discussions publiques portant sur le droit, l\u2019administration de la justice et la promotion et la protection des droits de l\u2019homme<\/strong>\u00a0et d\u2019adh\u00e9rer \u00e0 des organisations locales, nationales ou internationales, ou d\u2019en constituer, et d\u2019assister \u00e0 leurs r\u00e9unions sans subir de restrictions professionnelles du fait de leurs actes l\u00e9gitimes ou de leur adh\u00e9sion \u00e0 une organisation l\u00e9gitime. Dans l\u2019exercice de ces droits, des avocats doivent avoir une conduite conforme \u00e0 la loi et aux normes reconnues et \u00e0 la d\u00e9ontologie de la profession d\u2019avocat.\u00a0\u00bb<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h2><a id=\"Alerta2\"><\/a>GUINEE EQUATORIALE : L\u2019avocate Gemma Jones a \u00e9t\u00e9 retenue arbitrairement pendant plus de trois heures \u00e0 la Gendarmerie nationale \u00e0 Malabo, capitale de la R\u00e9publique de Guin\u00e9e \u00e9quatoriale<\/h2>\n<p><strong>8 novembre 2021<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Le 15 septembre 2021, l\u2019avocate \u00e9quatoguin\u00e9ene Gemma Jones a \u00e9t\u00e9 retenue arbitrairement par les forces de l\u2019ordre alors qu\u2019elle devait intervenir pour la Journ\u00e9e internationale de la d\u00e9mocratie.<\/strong><\/p>\n<p>L\u2019avocate \u00e9quatoguin\u00e9ene Gemma Jones, qui dirige le cabinet d\u2019avocats JONES &amp; SACRISTAN, fond\u00e9 en 2020, bas\u00e9 dans la capitale Malabo, est sp\u00e9cialis\u00e9e dans le conseil aux entreprises, ainsi que dans la d\u00e9fense des droits de l\u2019homme.<\/p>\n<p>Gemma Jones a r\u00e9cemment d\u00e9nonc\u00e9 publiquement, \u00e0 travers les r\u00e9seaux sociaux, le d\u00e9faut de motivation d\u2019une d\u00e9cision d\u2019irrecevabilit\u00e9 oppos\u00e9e \u00e0 une plainte formul\u00e9e par ses soins devant le tribunal d\u2019instruction n\u00b02 de la ville de Malabo dans un dossier mettant en cause la soci\u00e9t\u00e9 nationale d\u2019\u00e9lectricit\u00e9 (SEGESA) et certains de ses employ\u00e9s. La plainte portait sur les pratiques douteuses des inspecteurs de SEGESA et les atteintes port\u00e9es aux droits de propri\u00e9t\u00e9 des citoyens en Guin\u00e9e \u00e9quatoriale par la dite soci\u00e9t\u00e9.<\/p>\n<p>Suite \u00e0 cette plainte et ses d\u00e9clarations publiques, le cabinet de l\u2019avocate a subi une coupure brutale d\u2019\u00e9lectricit\u00e9.<\/p>\n<p>Le 15 septembre 2021, les forces de l\u2019ordre se sont rendus au cabinet de JONES &amp; SACRIST\u00c1N sans information pr\u00e9alable et sans mandat pour lui demander de se rendre \u00e0 la Gendarmerie pour \u00eatre entendue. Elle a alors \u00e9t\u00e9 inform\u00e9e d\u2019une enqu\u00eate portant sur les fuites des sujets du concours de cat\u00e9gorie B1 de la fonction publique d\u2019\u00e9tat organis\u00e9 le 12 septembre<\/p>\n<p>L\u2019avocate a m\u00eame mis \u00e0 la disposition des enqu\u00eateurs son t\u00e9l\u00e9phone pour prouver sa non-implication. Malgr\u00e9 cette clarification, Gemma Jones a \u00e9t\u00e9 retenue arbitrairement pendant plus de trois heures et n\u2019a pu intervenir \u00e0 la Journ\u00e9e internationale de la d\u00e9mocratie organis\u00e9e par l\u2019ambassade des \u00c9tats-Unis \u00e0 Malabo<\/p>\n<p><strong>L\u2019OIAD d\u00e9nonce<\/strong>\u00a0les pressions et intimidations \u00e0 l\u2019encontre de l\u2019avocate Gemma JONES<\/p>\n<p><strong>L\u2019OIAD rappelle<\/strong>\u00a0que l\u2019ind\u00e9pendance des avocats est l\u2019un des principaux indicateurs de la sant\u00e9 d\u00e9mocratique et de la consolidation de l\u2019\u00c9tat de droit. Ceci est conforme aux dispositions des Principes des Nations Unies relatifs au r\u00f4le du barreau.<\/p>\n<p><strong>L\u2019OIAD rappelle<\/strong>\u00a0l<strong>es Principes des Nations Unies relatifs au r\u00f4le du barreau<\/strong>, et en particulier aux principes 16 et 23 qui stipulent ce qui suit :<\/p>\n<p><strong>Principe 16 :<\/strong>\u00a0\u00a0\u00bb Les pouvoirs publics veillent \u00e0 ce que les avocats a) puissent s\u2019acquitter de toutes leurs fonctions professionnelles sans entrave, intimidation, harc\u00e8lement ni ing\u00e9rence indue; b) puissent voyager et consulter leurs clients librement, dans le pays comme \u00e0 l\u2019\u00e9tranger; et c) ne fassent pas l\u2019objet, ni ne soient menac\u00e9s de poursuites ou de sanctions \u00e9conomiques ou autres pour toutes mesures prises conform\u00e9ment \u00e0 leurs obligations et normes professionnelles reconnues et \u00e0 leur d\u00e9ontologie.\u00a0\u00bb<\/p>\n<p><strong>Principe 23 :<\/strong>\u00a0\u00a0\u00bb Les avocats, comme tous les autres citoyens, doivent jouir de la libert\u00e9 d\u2019expression, de croyance, d\u2019association et de r\u00e9union.
