Lawyer Saleh Nikbakht faces imminent imprisonment.<\/strong><\/p>\n<p>In 2023, the European Parliament decided to honour Jina-Mahsa Amini and the \u201cWomen, Life, Freedom\u201d movement by awarding them the Sakharov Prize for Freedom of Thought. <strong>Saleh Nikbakht<\/strong> was assigned to receive the prize on behalf of Jina\u2019s family, who had been deprived of all freedom of movement. He was arrested on his return to Iran.<\/p>\n<p>Released after lengthy interrogation, <strong>the lawyer was informed that he would soon be summoned to Evin prison to serve a one-year prison sentence handed down on 17 October 2023<\/strong>. The lawyer was convicted of \u201cpropaganda against the regime\u201d on the basis of a complaint lodged by the Iranian Ministry of Intelligence. The Iranian authorities accused the lawyer of advising the Amini family, giving interviews to the media and challenging the forensic institute\u2019s report on the cause of Jina-Mahsa Amini\u2019s death.<\/p>\n<p>Saleh Nikbakht has been defending journalists, human rights activists, writers, trade unionists and film-makers for years.\u00a0 A particularly talented lawyer, he has managed to get around thirty prisoners off death row by proving their innocence.\u00a0 It was thanks to his pugnacity and unfailing courage that the world learned of the grim conditions of Jina-Masha\u2019s death.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Observatory expresses its concern<\/strong> about the serious risk of imprisonment of lawyer Saleh Nikbakht.<\/p>\n<p><strong>The Observatory condemns in the strongest possible terms<\/strong> the sentencing of lawyer Saleh Nikbakht to one year\u2019s imprisonment, as well as his recent arrest, subsequent interrogation and the confiscation of his property upon his arrival in Iran.<\/p>\n<p><strong>The Observatory urges the Iranian authorities <\/strong>to cease harassing Saleh Nikbakht, who courageously practises his profession as a lawyer.<\/p>\n<p><strong>The Observatory recalls that<\/strong>, in accordance with the basic principles of the\u00a0<strong>United Nations relating to the role of the Bar<\/strong>, in particular\u00a0<strong>principles 16, 17 and 27<\/strong>:<\/p>\n<p><strong><u>Principle 16: \u201c<\/u><\/strong><em>Governments shall ensure that lawyers (a) are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference; (b) are able to travel and to consult with their clients freely both within their own country and abroad; and (c) shall not suffer, or be threatened with, prosecution or administrative, economic or other sanctions for any action taken in accordance with recognized professional duties, standards and ethics.\u201d<\/em><\/p>\n<p><strong><u>Principle 17<\/u><\/strong>:\u00a0<em>\u201cWhere the security of lawyers is threatened as a result of discharging their functions, they shall be adequately safeguarded by the authorities.\u201d<\/em><\/p>\n<p><strong><u>Principle 27<\/u><\/strong>:\u00a0<em>\u201c<\/em><strong><em>Charges or complaints made against lawyers<\/em><\/strong><em>\u00a0in their professional capacity shall be\u00a0<\/em><strong><em>processed expeditiously and fairly under appropriate procedures<\/em><\/strong><em>. Lawyers shall have the right to a fair hearing, including the right to be assisted by a lawyer of their choice.\u201d<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h2><a id=\"Alerta1\"><\/a>IRAN: A year after the death of Mahsa J\u00eena Amini, the family lawyer, Saleh Nikbakht, is brought to trial for carrying out his profession<\/h2>\n<p><strong>26 September 2023<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>The wave of protests following the death in custody of Mahsa J\u00eena Amini, a young Kurdish woman from Iran, aged 22, arrested for \u201cimproperly wearing the hijab\u201d triggered a violent crackdown that resulted in numerous executions and mass arrests of protesters and human rights activists, including many lawyers.<\/p>\n<p>As September marks the sad anniversary of Mahsa J\u00eena Amini\u2019s death in custody, the family\u2019s lawyer is being targeted by the Iranian authorities, accused of undermining the Islamic regime.<\/p>\n<p>Saleh Nikbakht has been charged with \u201cpropaganda against the Islamic Republic\u201d and faces a prison sentence of up to one year for his statement to the press in September 2022 that Mahsa J\u00eena Amini\u2019s family had filed a complaint against the police officers who arrested and interrogated her.<\/p>\n<p>The trial of lawyer Nikbakht, who is also President of the Association of Political Prisoners, began on Tuesday 29 August 2023 before the 28th Chamber of the Islamic Revolutionary Court in Tehran.<\/p>\n<p>Prominent lawyer, human rights defender and academic of Kurdish origin, Saleh Nikbakht defended many Iranian opponents and elected representatives in 2009 following the \u201cgreen movement\u201d that followed Mahmoud Ahmedinejad\u2019s controversial and corrupt presidential election. As a result, he was subjected to persecution and banned from leaving Iran on several occasions for carrying out his profession, in particular defending minorities.<\/p>\n<p>Saleh Nikbakht also defended Jafar Panahi, the Iranian filmmaker who won the Golden Lion at the Venice Film Festival and the Golden Bear at the Berlin Film Festival. Panahi was arrested in July 2022 for \u201cpropaganda against the Islamic Republic\u201d, and was released on bail in February 2023 after seven months of detention.<\/p>\n<p>At the age of 72, Saleh Nikbakht is one of a long line of lawyers targeted by Iran\u2019s Islamic regime, which persists in its brutal repression and shows no tolerance for popular and democratic expression.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Observatory expresses its indignation<\/strong> over the proceedings brought against Saleh Nikbakht, who courageously exercises his profession as a lawyer.<\/p>\n<p><strong>The Observatory is concerned<\/strong> about the persecution of lawyers in Iran.<\/p>\n<p><strong>The Observatory calls on the Iranian authorities<\/strong> to ensure the free and unhindered exercise of the legal profession in accordance with the United Nations Principles on the Role of Lawyers, adopted in Havana in 1990.<\/p>\n<p><strong>The Observatory recalls<\/strong> that, in accordance with the provisions of <strong>the United Nations Principles on the Role of Lawyers<\/strong>, in particular <strong>principles 16, 17, 27 and 28<\/strong>:<\/p>\n<p><strong><u>Principle 16<\/u><\/strong>: <em>\u201cGovernments shall ensure that lawyers (a) <strong>are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference<\/strong>; (b) are able to travel and to consult with their clients freely both within their own country and abroad; and (c) shall not suffer, or be threatened with, prosecution or administrative, economic or other sanctions for any action taken in accordance with recognized professional duties, standards and ethics.\u201d<\/em><\/p>\n<p><strong><u>Principle 17<\/u><\/strong>: <em>\u201cWhere the security of lawyers is threatened as a result of discharging their functions, they shall be adequately safeguarded by the authorities.\u201d<\/em><\/p>\n<p><strong><u>Principle 27<\/u><\/strong>: <em>\u201c<strong>Charges or complaints made against lawyers<\/strong> in their professional capacity shall be <strong>processed expeditiously and fairly under appropriate procedures<\/strong>.
