{"id":16673,"date":"2024-09-30T10:26:05","date_gmt":"2024-09-30T10:26:05","guid":{"rendered":"https:\/\/protect-lawyers.org\/case\/dauletmurat-tajimuratov\/"},"modified":"2025-03-26T09:35:41","modified_gmt":"2025-03-26T09:35:41","slug":"dauletmurat-tajimuratov","status":"publish","type":"listing","link":"https:\/\/protect-lawyers.org\/en\/case\/dauletmurat-tajimuratov\/","title":{"rendered":"Dauletmurat Tajimuratov"},"content":{"rendered":"<h4><a href=\"https:\/\/protect-lawyers.org\/en\/case\/dauletmurat-tajimuratov\/#Alerta2\">ALERT 30\/09\/2024<\/a><\/h4>\n<h4><a href=\"https:\/\/protect-lawyers.org\/en\/case\/dauletmurat-tajimuratov\/#Alerta1\">ALERT 22\/01\/2024<\/a><\/h4>\n<p>&nbsp;<\/p>\n<h2><a id=\"Alerta2\"><\/a><b><\/b>Uzbekistan :\u00a0persistent ill-treatment of Dauletmurat Tajimuratov in detention<\/h2>\n<p><strong>30 September 2024<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>In January 2023, Dauletmurat Tajimuratov was sentenced to 16 years in prison on charges linked to his role as a community leader and his advocacy for the protection of the rights of Karakalpaks.\u00a0Since then, he has been subjected to inhuman conditions, psychological and physical violence, and illegal restrictions on his correspondence.<\/strong><\/p>\n<p>In June 2024, Mr Tajimuratov reported that the prison authorities continued to restrict his exchanges with the outside world, blocking his letters and refusing to forward those he received. In particular, he did not receive the complaint sent by his lawyer for him to sign. He has also allegedly been subjected to acts of violence, including beatings by prison guards.<\/p>\n<p>His lawyer, Sergey Mayorov, filed several complaints to denounce the conditions in which his client was being held, but received no response from the authorities. Mr Tajimuratov is also subjected to forms of psychological torture, such as the continuous playing of loud music in his cell.<\/p>\n<p><strong>The Observatory strongly condemns<\/strong>\u00a0the conditions of detention and the ill-treatment inflicted on Dauletmurat Tajimuratov.<\/p>\n<p><strong>The Observatory calls<\/strong> on the authorities\u00a0to put an immediate end to the ill-treatment and psychological torture inflicted on the lawyer and to guarantee him unhindered access to his lawyers and personal correspondence.<\/p>\n<p><strong>The Observatory urges the authorities<\/strong>\u00a0to unconditionally release Dauletmurat Tajimuratov, who is being detained solely for his human rights work.<\/p>\n<p><strong>The Observatory recalls<\/strong>\u00a0that, according to the\u00a0United Nations Basic Principles on the Role of the Bar, in particular\u00a0Principle 27:<\/p>\n<p>\u201cCharges or complaints made against lawyers\u00a0in their professional capacity shall be\u00a0processed expeditiously and fairly under appropriate procedures. Lawyers shall have the right to a fair hearing, including the right to be assisted by a lawyer of their choice.\u201d (Principle 27)<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h2><a id=\"Alerta1\"><\/a>Uzbekistan: lawyer Dauletmurat Tajimuratov arbitrarily detained<\/h2>\n<p><strong>22 January 2024<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Dauletmurat Tajimuratov is a lawyer and human rights defender. He advocates for the protection of the rights of the Karakalpak people and for the protection of the Autonomous Republic of Karakalpakstan in Uzbekistan.<\/strong><\/p>\n<p>In 2022, the Uzbek government\u2019s repression of the Karakalpak population intensified, with the right to secede from Uzbekistan being taken away by an amendment to the Uzbek Constitution proposed by President Shavkat Mirziyayev.<\/p>\n<p>In this context, lawyer Dauletmurat Tajimuratov announced that he would hold a peaceful demonstration. However, he was arrested by the Uzbek authorities, who sought to prevent the demonstration.<\/p>\n<p>Demonstrations nevertheless took place in Nukus, the capital of the Autonomous Republic of Karakalpakstan. These were violently repressed and led to the declaration of a state of emergency by the Uzbek government.<\/p>\n<p>At the same time, Dauletmurat Tajimuratov was arrested for \u201corchestrating mass riots, attempting to seize power and distributing documents containing threats to national security\u201c. He was sentenced to 16 years in prison on 31 January 2023.<\/p>\n<p>L The lawyer denounced the inhuman conditions and ill-treatment suffered during his detention. His lawyer, Sergey Mayorov, also denounced his client\u2019s conditions in prison[1], who does not have access to health care or adequate food. In addition, he is almost entirely deprived of contact with the outside world.<\/p>\n<p>According to the Office of the United Nations High Commissioner for Human Rights, which is concerned about the situation of Dauletmurat Tajimuratov, \u00ab\u00a0his head was forcibly shaved, and prison officers forced other detainees to intimidate and harass him\u00a0\u00bb[2].<\/p>\n<p><strong>The Observatory strongly condemns\u00a0<\/strong>the Uzbek authorities\u2019 repression of Dauletmurat Tajimuratov.<\/p>\n<p><strong>The Observatory urges the Uzbek authorities\u00a0<\/strong>to carry out an independent investigation into the allegations of inhuman and degrading treatment suffered by Tajimuratov in detention.<\/p>\n<p><strong>The Observatory calls on the government of\u00a0<\/strong>Uzbekistan to comply with\u00a0<strong>Article 1, paragraph 2, of the United Nations Charter<\/strong>, in particular the \u201crespect for the principle of equal rights and self-determination of peoples\u201d.<\/p>\n<p><strong>The Observatory recalls\u00a0<\/strong>that, in accordance with the<strong>\u00a0United Nations basic principles on the role of the Bar,\u00a0<\/strong>in particular<strong>\u00a0principles 16, 17, 23 and 27:<\/strong><\/p>\n<p><strong><u>Principle 16<\/u><\/strong>:\u00a0<em>\u201cGovernments shall ensure that lawyers (a)\u00a0<strong>are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference<\/strong>;\u201d<\/em><\/p>\n<p><strong><u>Principle 17<\/u><\/strong>:\u00a0<em>\u201cWhere the security of lawyers is threatened as a result of discharging their functions, they shall be\u00a0<strong>adequately safeguarded by the authorities<\/strong>.\u201d<\/em><\/p>\n<p><strong>Principle 23<\/strong>:\u00a0<em>\u201c<\/em><strong><em>Lawyers like other citizens are entitled to freedom of expression, belief, association and assembly<\/em><\/strong><em>. In particular, they shall have the right to take part in public discussion of matters concerning the law, the administration of justice and the promotion and protection of human rights and to join or form local, national or international organizations and attend their meetings, without suffering professional restrictions by reason of their lawful action or their membership in a lawful organization. In exercising these rights, lawyers shall always conduct themselves in accordance with the law and the recognized standards and ethics of the legal profession.\u201d<\/em><\/p>\n<p><strong><u>Principle 27<\/u><\/strong>:\u00a0<em>\u201c<strong>Charges or complaints made against lawyers<\/strong>\u00a0in their professional capacity shall be\u00a0<strong>processed expeditiously and fairly under appropriate procedures<\/strong>.
