{"id":18037,"date":"2024-07-22T14:44:53","date_gmt":"2024-07-22T14:44:53","guid":{"rendered":"https:\/\/protect-lawyers.org\/case\/noureddine-bhiri\/"},"modified":"2025-03-17T16:46:57","modified_gmt":"2025-03-17T16:46:57","slug":"noureddine-bhiri","status":"publish","type":"listing","link":"https:\/\/protect-lawyers.org\/it\/case\/noureddine-bhiri\/","title":{"rendered":"Noureddine Bhiri"},"content":{"rendered":"<h2>TUNISIA: Lawyer Noureddine Bhiri rushed to hospital after 15-day hunger strike in prison<\/h2>\n<p><strong>18 July, 2024<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>On 12 July 2024, Noureddine Bhiri, member of the Tunis Bar who had been under arrest since February 2023, was admitted to intensive care at La Rabta hospital in Tunis.\u00a0<\/strong><strong>Mr Bhiri had begun a hunger strike on 28 June 2024.<\/strong><\/p>\n<p>Me Bhiri was violently arrested on 13 February 2023, charged with \u201cattempting to change the form of government\u201d for allegedly posting a message deemed critical of the Tunisian government on Facebook. This charge could result in his being sentenced to death.<\/p>\n<p>Since his arrest, he has been held in Mornaguia prison, from where he began a hunger strike on 28 June 2024. Mr Bhiri is protesting against the inaction of the public prosecutor\u2019s office in response to the complaints he lodged more than a year ago, alleging torture and ill-treatment by police officers.<\/p>\n<p>Following the deterioration of his health as a result of his hunger strike, Noureddine Bhiri has been urgently hospitalised since 12 July 2024.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Observatory expresses\u00a0<\/strong>its utmost concern about the state of health of Mr Noureddine Bhiri and<strong>\u00a0demands that the Tunisian authorities\u00a0<\/strong>preserve his life and physical integrity.<\/p>\n<p><strong>The Observatory urges the Tunisian authorities\u00a0<\/strong>to release Mr Noureddine Bhiri immediately and unconditionally.<\/p>\n<p><strong>The Observatory strongly condemns\u00a0<\/strong>this clear attack on the freedom of expression of lawyer Noureddine Bhiri.<\/p>\n<p><strong>The Observatory recalls the principle of prohibition of acts of violence against persons deprived of their liberty contained in article 16, paragraph 1, of the 1984 Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which states that<em>\u00a0\u201cEach State Party shall undertake to prevent in any territory under its jurisdiction other acts of cruel, inhuman or degrading treatment or punishment which do not amount to torture as defined in article I, when such acts are committed by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.\u00a0 (\u2026) \u201c.<\/em><\/strong><\/p>\n<p><strong>L\u2019Observatoire rappelle<\/strong>\u00a0le principe d\u2019<u>interdiction des actes de violence contre les personnes priv\u00e9es de libert\u00e9<\/u>\u00a0de\u00a0<strong>l\u2019article 16<\/strong>,\u00a0<strong>paragraphe 1<\/strong>, de la\u00a0<strong>Convention contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants de 1984<\/strong>, qui dispose que \u00ab\u00a0<em>Tout Etat partie s\u2019engage \u00e0 interdire dans tout territoire sous sa juridiction d\u2019autres actes constitutifs de peines ou traitements cruels, inhumains ou d\u00e9gradants qui ne sont pas des actes de torture telle qu\u2019elle est d\u00e9finie \u00e0 l\u2019article premier lorsque de tels actes sont commis par un agent de la fonction publique ou toute autre personne agissant \u00e0 titre officiel, ou \u00e0 son instigation ou avec son consentement expr\u00e8s ou tacite (\u2026)<\/em>.\u00a0\u00bb.<\/p>\n<p><strong>The Observatory reminds<\/strong>\u00a0the Tunisian State that according to\u00a0<strong>article 19, paragraphs 1 and 2, of the International Covenant on Civil and Political Rights<\/strong>, ratified by Tunisia in 1969, \u201c<em>1. Everyone shall have the right to hold opinions without interference. ; 2.
