07 August 2024<\/strong><\/p>\n <\/p>\n On 2 July 2024, lawyers Naim Emino\u011flu and Do\u011fa \u0130ncesu were arrested following a raid on their homes. The two lawyers, both members of the Association of Progressive Lawyers (\u201c\u00c7HD\u201d) in Turkey, were due to appear in court for a hearing on 2 July and were taken into custody by the Turkish authorities.<\/strong><\/p>\n Neither the prosecutor nor a representative of the bar association were present at the time of the proceedings. The lawyers\u2019 phones and computers were confiscated by the police for examination. Emino\u011flu and \u0130ncesu were not informed of the charges against them.<\/p>\n Naim Emino\u011flu and Do\u011fa \u0130ncesu were actually charged with propaganda and membership of a terrorist organisation based on the statements of a witness. Their arrest and the charges brought against them were strongly condemned by the international community, which denounced the harassment of the lawyers who were members of the \u00c7HD.<\/p>\n The lawyers, represented by three of their colleagues from the \u00c7HD, were released on bail on 5 July 2024.<\/p>\n The Observatory welcomes<\/strong>\u00a0the decision to release the Turkish lawyers Naim Emino\u011flu and Do\u011fa \u0130ncesu after their\u00a0arbitrary arrest on 2 July 2024.<\/p>\n The Observatory remains concerned<\/strong>\u00a0about the situation of human rights lawyers in Turkey.<\/p>\n The Observatory urges the Turkish authorities<\/strong>\u00a0to cease all pressure against the legal profession.<\/p>\n The Observatory recalls<\/strong>\u00a0that, in compliance with the\u00a0United Nations basic principles on the role of the Bar<\/strong>, in particular\u00a0principles 16, 22, 23 and 27<\/strong>:<\/p>\n \u201cGovernments shall ensure that lawyers (a)\u00a0are able to perform all of their professional functions without intimidation, hindrance, harassment or improper interference<\/strong>; (\u2026).\u201d\u00a0<\/em>(Principle 16)<\/u><\/p>\n \u201cGovernments shall recognize and respect that\u00a0all communications and consultations between lawyers and their clients within their professional relationship are confidential<\/strong>.\u201d<\/em>\u00a0(Principle 22)<\/u><\/em><\/p>\n \u201cLawyers like other citizens are entitled to freedom of expression, belief, association and assembly<\/strong>. In particular, they shall have the right to take part in public discussion of matters concerning the law, the administration of justice and the promotion and protection of human rights and to join or form local, national or international organizations and attend their meetings, without suffering professional restrictions by reason of their lawful action or their membership in a lawful organization. (\u2026).\u201d (Principle 23)<\/u><\/em><\/p>\n \u201cCharges or complaints made against lawyers<\/strong>\u00a0in their professional capacity shall be\u00a0processed expeditiously and fairly under appropriate procedures<\/strong>.
