Bangladesh: Judicial harassment and discriminatory measures against lawyers
The OIAD is deeply concerned about the alarming wave of persecution, intimidation and political discrimination targeting many lawyers in Bangladesh. These practices, which seem to be part of a coordinated strategy, seriously undermine the independence of the legal profession and access to justice in the country.
Unfounded criminal charges against Bangladeshi lawyers
A series of extremely serious criminal charges have been brought against several lawyers in Bangladesh, accused of crimes such as murder, violence, use of explosives and disturbing public order. These charges are part of a systematic crackdown aimed at intimidating lawyers and limiting the independence of the profession.
Those targeted include several prominent members of the Bar, known for their professional commitment and integrity. The charges appear not only arbitrary but also clearly political, particularly against lawyers perceived as close to the ruling party.
These measures aim to create a climate of widespread fear, hindering lawyers’ ability to practise their profession freely and without pressure, and undermining fundamental guarantees of the rule of law.
Obstacles to democratic participation within the Bar
Similarly, thirteen lawyers running for leadership positions within the Dinajpur Bar Association were unilaterally disqualified on 29 March 2025. This decision, taken by the Chief Election Commissioner on the grounds of the candidates’ alleged political affiliation with the ruling majority, has been denounced as arbitrary and discriminatory.
There appears to be no statutory provision justifying this exclusion. The context also suggests that the electoral process is being exploited for political interests, in disregard of the principles of impartiality and transparency.
This situation violates, in particular, the rights guaranteed by the Constitution of Bangladesh, notably Articles 27 and 31, relating to equality before the law and the right to legal protection.
The Observatory strongly condemns the harassment, threats and abusive prosecution of Bangladeshi lawyers.
The Observatory calls on the Bangladeshi authorities to guarantee an independent, impartial and transparent investigation into the prosecution of these lawyers.
The Observatory urges the Bangladeshi authorities to restore the rights of participation of candidates unfairly disqualified from the professional elections.
Finally, the Observatory calls on the Bangladeshi authorities to comply with the principle of guaranteeing the independence of the legal profession, in accordance with the United Nations Basic Principles on the Role of Lawyers.
